1 The agreement
These terms are an agreement between you and Vance Labs LLC, the company behind Nacho (usenacho.com). By creating an account or using Nacho, you agree to them.
2 The service
Nacho answers your restaurant's phone with an AI voice host. You forward your phone line to a number we provide; Nacho answers calls, shares the menu information you configured, takes orders, and can send text updates. Callers are speaking with an AI assistant, and calls are transcribed (and may be recorded) so you can review them.
3 Your account
Keep your account information accurate and your sign-in credentials safe — you are responsible for activity under your account. You must be authorized to act for the restaurant you connect, including forwarding its phone line.
4 Plans and billing
Nacho is a paid subscription, billed monthly or yearly through our payment processor (Stripe). Current plans and pricing are listed on our website. Each plan includes a monthly allowance of call minutes, shared across all your locations, that resets on your billing date, and a set number of Nacho phone numbers (one per location). Each additional number costs $1.50 a month ($18 a year on yearly plans), added to the same bill.
Minutes past your plan are paid from Reserve, a prepaid balance, at 60¢ a minute. Reserve is optional and starts at $0. You can add to it anytime, or turn on automatic top-ups, which are off unless you turn them on: when your balance runs low we charge your card the amount you chose. Reserve is not refundable; any balance stays on your account for as long as you have one, and it never keeps a lapsed subscription active.
If your plan's minutes are used up and your Reserve can't cover more, Nacho stops answering new calls until you add to your Reserve or your minutes reset. We never hang up on a call in progress, so a final call may run past your balance; those minutes are added to your next charge.
Subscriptions renew automatically. You can cancel anytime and your service continues through the end of the period you paid for. If Nacho isn't working out within your first 30 days, tell us and we'll refund your subscription. If we change prices, we'll give you advance notice before your next renewal.
5 Text messaging program
Nacho sends order-update text messages, which can include the restaurant's payment link, only to callers who say yes when Nacho asks during their call (the exact words are on our text messages page). We never send marketing texts. Message frequency: usually one text per order. Message and data rates may apply. Recipients can reply STOP to opt out at any time or HELP for assistance. Wireless carriers are not liable for delayed or undelivered messages. Our privacy policy describes how messaging data is handled.
6 Your responsibilities
Nacho quotes what you configure — keep your menu, prices, and hours accurate. You remain responsible for your restaurant's own obligations to its customers, including preparing orders, food safety, pricing, and taxes, and for using Nacho in compliance with the laws that apply to your business.
7 Acceptable use
Don't use Nacho for anything unlawful, deceptive, or abusive; don't send spam or unsolicited messages through it; don't interfere with the service or attempt to access other customers' data; and don't reverse engineer it.
8 What we promise — and what we can't
We work hard to keep Nacho accurate and available: prices come from the data you configure, never guessed. Still, Nacho is an AI system — it can occasionally mishear a caller or make a mistake — and the service is provided "as is," without warranties of any kind. Nacho assists your business; it does not replace your judgment.
9 Limitation of liability
To the fullest extent permitted by law, Vance Labs LLC's total liability for any claims relating to Nacho is limited to the amount you paid us in the twelve months before the claim, and we are not liable for indirect, incidental, or consequential damages, including lost profits.
10 Ending service
You can cancel from the dashboard at any time. We may suspend or end service for violation of these terms or non-payment. When an account closes, we release its Nacho phone number and delete its data as described in the privacy policy.
If a payment fails, Nacho stops answering calls right away. We'll keep trying your card and let you know. We hold your Nacho phone number for a short time after a failed payment; if you update your card during that time, your service and your number come back. After that, the number is released and may not be available again. If you return later, we'll set you up with a new number.
11 Intellectual property
We own the Nacho service and software. You own your business data — your menu, hours, and customer information — and you give us permission to use it solely to run the service for you.
12 Governing law
These terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-law rules.
13 Changes to these terms
If we make material changes, we'll post the updated terms here and notify account holders before the changes take effect.
